These Terms of Service ("Terms") govern your access to and use of the Omni mobile application and related services (collectively, the "Service"). By creating an account, accessing, or using Omni, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Service Description
Omni is a location-based social networking application that enables users to:
- Discover and interact with people and places on a real-time map
- Check in to places and see who's nearby
- Detect encounters with other users through the "Passed By" feature
- Send and receive messages in direct and group conversations
- Play interactive social games (Two Truths & One Lie, Would You Rather, Guess About Me, This or That)
- Create, share, and manage personal profiles
- Access premium features through Omni Plus subscription and one-time purchases
3. Eligibility
You must be at least 18 years old to create an account or use Omni. By using the Service, you represent and warrant that you meet this age requirement. We may request verification of your age at any time and may terminate accounts that do not meet this requirement.
4. Account Registration & Security
- You must provide accurate and complete information when creating your account
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activity that occurs under your account
- You must notify us immediately of any unauthorized access to your account
- You may not create multiple accounts, share accounts, or transfer your account to another person
- Usernames are subject to automated profanity filtering and may be rejected or modified at our discretion
5. Acceptable Use
You agree to use Omni in accordance with these Terms, our Community Guidelines, and all applicable laws. You agree not to:
- Harass, bully, threaten, stalk, or intimidate other users
- Post or transmit content that is hateful, discriminatory, violent, sexually exploitative, or illegal
- Impersonate another person or create deceptive/misleading profiles
- Spam, scam, phish, or distribute malware or fraudulent links
- Manipulate the referral system, reporting tools, or other Service features
- Use the Service for commercial solicitation without our prior consent
- Attempt to reverse-engineer, decompile, or tamper with the app or its security measures
- Use bots, scrapers, or automated tools to access the Service
- Circumvent bans, blocks, or other enforcement actions
- Abuse location features to track, stalk, or surveil other users
6. User Content & Moderation
6.1 Your Content
You retain ownership of the content you create and submit through Omni (messages, profile information, game responses). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your content solely for the purpose of operating and providing the Service.
6.2 Content Moderation
We reserve the right to review, monitor, filter, restrict, remove, or moderate any user content or accounts at our sole discretion, including through automated systems (such as profanity filtering) and manual review, to enforce these Terms, our Community Guidelines, and legal requirements.
6.3 Reporting
You can report content or users that violate these Terms or our Community Guidelines using the in-app reporting tools. We will review reports and take appropriate action, which may include content removal, account warnings, temporary restrictions, or permanent bans.
7. Location Services
- Certain features (map, discovery, places, check-ins, encounters) require access to your device's location services
- Location data is collected only while the app is in active use and you have granted permission
- You can control your location visibility through in-app privacy settings (hide exact location, hide online status)
- You can revoke location permission at any time through your device's settings
- You must not use location features to stalk, harass, or endanger other users
8. Advertising
- Omni displays advertisements to users who are not subscribed to Omni Plus. Ads are served by Google AdMob
- Ads may appear as interstitial (full-screen) formats during natural transition points in the app
- On iOS, you will be asked to consent to ad tracking via Apple's App Tracking Transparency framework. You may accept or decline — the app functions fully regardless of your choice
- Omni Plus subscribers enjoy a completely ad-free experience — no ads are displayed, and no advertising data is collected or shared with ad networks
- Ad content is provided by third-party advertisers. We do not endorse and are not responsible for the content, products, or services advertised
9. In-App Purchases & Subscriptions
9.1 Omni Plus Subscription
- Omni Plus is available as a weekly or monthly auto-renewing subscription
- Subscriptions are billed through the Apple App Store
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
- You can manage or cancel your subscription at any time through your device's App Store subscription settings
- Omni Plus benefits include ad-free experience, priority placement in check-in lists, and access to the Passed By feature
9.2 One-Time Purchases
- Place Credits: Consumable credits that allow you to create additional places. Credits do not expire and are non-transferable
- Radius Passes: Timed access passes that expand your discovery radius for a set duration (e.g. 1 hour, 3 hours, 24 hours). Once activated, Radius Passes cannot be paused or refunded
9.3 Pricing & Refunds
- All prices are displayed in your local currency and may include applicable taxes
- Prices may vary by country/region and are subject to change
- Refunds are handled exclusively by the Apple App Store in accordance with their refund policy
- Deleting your account does not automatically cancel active subscriptions — you must cancel through the App Store
10. Privacy
Your use of Omni is also governed by our Privacy Policy, which describes how we collect, use, share, and protect your personal data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
11. Third-Party Services
Omni integrates with third-party services to provide its functionality, including Supabase (infrastructure), Firebase Cloud Messaging (push notifications), RevenueCat (purchase management), Google AdMob (advertising), and authentication providers (Google, Apple). These services are governed by their own terms and privacy policies. We are not responsible for third-party service availability or practices.
12. Intellectual Property
- All rights, title, and interest in the Omni application, including its design, code, branding, trademarks, and original content (excluding user-generated content), are owned by Omni or its licensors
- You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of the Service without our prior written consent
- The Omni name, logo, and related marks are trademarks of Omni. You may not use them without our prior written permission
13. Termination
13.1 By You
You may stop using Omni at any time. You may request account deletion from within the app (Settings). Account deletion does not automatically cancel active App Store subscriptions.
13.2 By Us
We may suspend, restrict, or permanently terminate your account if:
- You violate these Terms or our Community Guidelines
- Your conduct poses a risk to the safety of other users
- We are required to do so by law or legal process
- Your account has been inactive for an extended period
Where possible, we will provide notice before termination. In cases involving immediate safety risks or legal requirements, we may act without prior notice.
14. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, statutory, or otherwise
- We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components
- We do not guarantee the accuracy, completeness, or reliability of any user-generated content, location data, or third-party content
- We are not responsible for any interactions, meetings, or relationships that may result from your use of the Service
- Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, death, or personal injury caused by negligence
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Omni, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of or inability to use the Service, regardless of the theory of liability.
Our total aggregate liability for all claims arising out of or related to these Terms or the Service shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) £100.
These limitations apply to the fullest extent permitted by law and do not affect your statutory rights as a consumer.
16. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Omni from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service, (b) your violation of these Terms, (c) your content, or (d) your violation of any rights of a third party.
17. Governing Law & Dispute Resolution
These Terms are governed by the laws of England and Wales, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Nothing in this section overrides mandatory consumer protection laws in your country of residence that may apply to you.
18. Modifications to Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Provide notice through the app or other reasonable means where required
Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service.
19. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and Omni
- Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force
- No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision
- Assignment: We may assign our rights and obligations under these Terms. You may not assign yours without our prior written consent
